NO TEST DRIVES UNTIL REPAIRS ARE COMPLETE. VEHICLE IS AVAILABLE FOR VIEWING ONLY. SUBCHAPTER C. TRANSFER OF OWNERSHIP OF CERTAIN EMERGENCY VEHICLES Sec. 728.021. TRANSFER OF OWNERSHIP OF CERTAIN EMERGENCY VEHICLES; OFFENSE. (a) The owner of an authorized emergency vehicle that is used to transport sick or injured persons commits an offense if the owner transfers ownership of the vehicle without: (1) removing from the vehicle any vehicle equipment, including a light, siren, or device, that under Subtitle C only an authorized emergency vehicle may be equipped with; and (2) removing or obliterating any emblem or marking on the vehicle that identifies the vehicle as an authorized emergency vehicle. (b) Subsection (a) does not apply if the owner of the vehicle transfers ownership of the vehicle to a person: (1) who holds a license as an emergency medical services provider under Chapter &&&a href="http://www.statutes.legis.state.tx.us/GetStatute.aspx?Code=HS&Value=773" target="new"&&&773, Health and Safety Code; (2) who is in the business of buying and selling used vehicles in this state and who specializes in authorized emergency vehicles; or (3) described by Section &&&a href="http://www.statutes.legis.state.tx.us/GetStatute.aspx?Code=TN&Value=541.201" target="new"&&&541.201 or a similar person operating in a foreign country. (c) An offense under this section is a Class C misdemeanor. (d) In this section: (1) "Authorized emergency vehicle" has the meaning assigned by Section &&&a href="http://www.statutes.legis.state.tx.us/GetStatute.aspx?Code=TN&Value=541.201" target="new"&&&541.201. (2) "Vehicle equipment" has the meaning assigned by Section &&&a href="http://www.statutes.legis.state.tx.us/GetStatute.aspx?Code=TN&Value=547.001" target="new"&&&547.001. Acts 1995, 74th Leg., ch. 165, Sec. 1, eff. Sept. 1, 1995. Sec. 728.022. SALE OR TRANSFER OF LAW ENFORCEMENT VEHICLE. (a) A person may not sell or transfer a marked patrol car or other law enforcement motor vehicle to the public unless the person first removes any equipment or insignia that could mislead a reasonable person to believe that the vehicle is a law enforcement motor vehicle, including any police light, siren, amber warning light, spotlight, grill light, antenna, emblem, outline of an emblem, or emergency vehicle equipment. (b) A person may not sell or transfer a marked patrol car or other law enforcement motor vehicle to a security services contractor who is regulated by the Department of Public Safety and licensed under Chapter &&&a href="http://www.statutes.legis.state.tx.us/GetStatute.aspx?Code=OC&Value=1702" target="new"&&&1702, Occupations Code, unless each emblem or insignia that identifies the vehicle as a law enforcement motor vehicle is removed before the sale or transfer. (c) A person who sells or transfers a marked patrol car or other law enforcement motor vehicle to the public in violation of this section is liable: (1) for damages proximately caused by the use of that vehicle during the commission of a crime; and (2) to this state for a civil penalty of $1,000. (d) The attorney general may bring an action to recover the civil penalty imposed under Subsection (c)(2). Added by Acts 2017, 85th Leg., R.S., Ch. 1068 (H.B. 3223 ), Sec. 2, eff. September 1, 2017.
